Art. 1 – General Provisions

2. These General Terms of Sale apply exclusively to the sale of products made on the site in accordance with Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by

3. The user is required, before accessing the products provided by the site, to read these General Terms of Sale, which are deemed generally and unequivocally accepted upon purchase.
4. The user is invited to download and print a copy of the purchase form and these General Terms of Sale, the terms of which MVT srl reserves the right to modify unilaterally and without notice.

Art. 2 – Subject
1. These General Terms of Sale govern the offer, forwarding, and acceptance of purchase orders for products on MVT srl and do not govern the provision of services or the sale of products by parties other than the seller that may be present on the same site via links, banners, or other hypertext links.
2. Before placing orders and purchasing products and services from such parties, we recommend checking their sales conditions.
Art. 3 – Conclusion of the Contract
1. To complete the purchase contract, it will be necessary to complete the form in electronic format and send it following the related instructions.
2. The form includes a reference to the General Terms of Sale, images of each product and its price, the available payment methods, delivery methods for purchased products and their shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, and methods and times for returning purchased products.
3. Before finalizing the contract, users will be asked to confirm that they have read the General Terms of Sale, including the Notice on the Right of Withdrawal and the Privacy Policy.
4. The contract is concluded when the seller receives the form completed by the user, after verifying the correctness of the data contained.
5. The buyer will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will happen by clicking the “place order” button at the end of the guided procedure.
6. Once the contract is concluded, the seller takes charge of the order for processing.
Art. 4 – Registered Users
1. When completing the registration process, the user agrees to follow the instructions on the site and to provide their personal data accurately and truthfully.
2. Confirmation will release MVT srl from any responsibility regarding the data provided by the user. The user agrees to promptly inform MVT srl of any changes to the data provided at any time.
3. If the user provides inaccurate or incomplete data or if there is a dispute from the interested parties regarding payments, MVT srl reserves the right not to activate or suspend the service until the relative shortcomings are rectified.
4. Upon the first request to activate a profile by the user, MVT srl will assign a username and password. The user acknowledges that these identifiers constitute the user’s access validation system to the Services and the only system suitable for identifying the user. Actions taken using such access will be attributed to and have binding effect on the user.
5. The user agrees to maintain the secrecy of their access data and to protect it with due care and diligence, and not to transfer it temporarily to third parties.
Art. 5 – Product Availability
1. Product availability refers to actual availability at the time the buyer places the order. However, this availability must be considered purely indicative as, due to the simultaneous presence of multiple users on the site, products may be sold to other customers before the order is confirmed.
2. Even after sending the order confirmation email, partial or total unavailability of the goods may occur. In such an eventuality, the order will be automatically adjusted with the elimination of the unavailable product and the buyer will be immediately informed by email.
3. If the buyer requests the cancellation of the order, thus terminating the contract, MVT srl will reimburse the amount paid within 20 days from the moment MVT srl is aware of the buyer’s decision to terminate the contract.

Art. 7 – Payment Methods and Prices
1. The price of the products will be the one indicated on the site, except in cases of manifest error.
2. In case of error, MVT srl will promptly inform the buyer, allowing them to confirm the order at the correct price or cancel it. MVT srl is not obligated to provide the sold item at the lower price if it was incorrectly indicated.
3. The site’s prices include VAT but do not include shipping costs. Prices are subject to change at any time. Changes do not affect orders for which an order confirmation has already been sent.
4. Once the desired products have been selected, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the requested information at each step. Order details can be modified before payment.

Art. 8 – Delivery
1. MVT srl ships throughout Italy, excluding the Vatican City State and the Republic of San Marino.
2. MVT srl will deliver to both the address provided by the user and the pick-up points indicated at the time of purchase.
3. Delivery generally occurs within 24/48 hours, considering standard business days (Monday to Friday) and 48/72 hours for islands, or, if no delivery date is specified, within the estimated timeframe selected during checkout and, in any case, within a maximum period of thirty days from the order confirmation date.
4. If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify the order location and how to arrange a new delivery.
5. If the user is unable to be present at the delivery location at the agreed time, they are asked to contact us again to arrange a new delivery date.
6. If delivery is not possible for reasons not attributable to us after thirty days from when the order is available for delivery, we assume the contract is intended to be resolved.
7. Following the termination, amounts will be refunded, excluding delivery costs and any additional charges resulting from the choice of a delivery method other than the standard offered, without undue delay and, in any case, within 20 days from the contract termination date. Transport costs due to contract termination may incur additional fees at the buyer’s expense.
8. Shipping costs are borne by the buyer and are explicitly highlighted at the time of order placement.
Art. 9 – Risk Transfer
1. Product risks are transferred to the buyer upon delivery. Ownership of the products is acquired as soon as payment is received in full for all amounts due, including shipping costs, or upon delivery if this occurs later.
Art. 10 – Warranty and Commercial Compliance
1. The seller is responsible for any defect in the products offered on the site, including non-compliance with the ordered products, in accordance with Italian law.
2. If the buyer has entered into the contract as a consumer (meaning any individual acting on the site for purposes unrelated to any business or professional activity), this warranty is valid on the condition that the defect becomes apparent within 24 months from the product delivery date and that the buyer files a formal complaint regarding the defects within a maximum of 2 months from when the defect was discovered.
3. In case of non-compliance, the consumer who has entered into the contract can request, at no cost, under the following conditions, the repair or replacement of the purchased goods, a reduction in the purchase price, or the contract termination regarding the disputed goods and the resulting refund.
4. All return costs for defective products will be borne by the seller.
